These Terms & Conditions ("Terms") govern your use of Le'an Aliyah / Le'an Aliyah (the "Service"), operated by Aaron Rosenthal ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms.

1. The Service

The Service is an Aliyah community planning platform that helps you compare and evaluate Israeli communities using structured data and personal factors.

2. Your account

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be of legal age in your jurisdiction or have the authority to bind the organisation you represent.

3. Acceptable use

You agree not to misuse the Service, including by:

• Using the Service unlawfully or for fraudulent or deceptive purposes;
• Sending spam or unsolicited messages;
• Infringing intellectual property or privacy rights of others;
• Interfering with the security or integrity of the Service (malware, probing, scraping, circumventing rate limits or access controls).

4. Intellectual property

We retain all rights, title, and interest in and to the Service, including its software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal or internal business use. You may not reverse engineer, resell, or redistribute the Service, or circumvent its technical limits.

5. Your content

You retain ownership of the content you create in the Service. You grant us a limited license to host, store, and process that content solely to provide the Service to you.

6. Fees and payment — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

7. Service level

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or that defects will be corrected. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of the fees you paid us in the 12 months preceding the claim, or USD 100. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. fraud, death, or personal injury caused by our negligence).

9. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of applicable law or the rights of a third party.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your content after a reasonable period.

11. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use after the changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction of Aaron Rosenthal's principal place of residence, without regard to conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, subject to any mandatory consumer protection rights you may have in your country of residence.

13. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
